Alpheus C. Montanye


NO 84 of 1908


I, Alpheus C. Montanye being of sound and disposing mind, memory, and understanding, do make, and publish and declare the following to be my last will and testament, hereby revoking all former will by me at any time here tofore made:

I give, devise and bequeath all my estate , real, personal and mixed to my beloved wife, Helen Montanye, for herself and her heirs forever, and I appoint her as sole executrix hereof.

In testimony whereof, I have hereunto set my hand and seal this 10th day of June 1899.

Signed, sealed, published and declared by the above named Alpheus C. Montanye, as and for his last will and testament, in the presence of us, Who, at his request and in his presence, and in presence of each other, have hereunto subscribed our names as witnesses thereto.

This day , before me, Frank A. Battle Esq., Register of Wills, in and for the county aforesaid, personally came W. R. Robinson who being duly sworn according to law, says that he is well aquainted with Byran G. Hahn late a resident of the city of Wilkes-Barre in the county of Luzerne, State of Penna who was one of the subscribing witnesses to the Last Will and Testament of Alpheus C. Montanye, late of the city of Wilkes-Barre Luzerne County, State of Penna, deceased; that he is familiar with the handwriting of said Byran G. Hahn having frequently seen him write his own name as well as other matters;(now resides in Syracuse N.Y. that he has carefully examined the signature of Byran G. Hahn) as well as other matters; that the said Byran G. Hahn to the aforesaid Last Will and Testament dated the 10th day of June, A.D. 1889, and verily believes the same to be in his own proper handwriting of said.

This day before me Frank A. Battle; Register of Wills in and for the county of Luzerne aforesaid personally came Burt Voorhis one of the subscribing witnesses to the above and foregoing last will and testament of Alpheus C. Montanye of the City of Wilkes-Barre,Luzerne County, State of Penna, deceased, who, being duly sworn according to law says he was present and saw Alpheus C. Montanye testator, sign, seal, publish, pronounce and declare the foregoing instrument of writing as and for his last will and testament, and that at the time of so doing he was of sound mind, memory, and understanding, to the best of his knowledge and belief, and that he did sign his name as a subscribing witness in the presence of Byran G. Hahn and in the presence and request of said testator. Sworn and Subscribed before me the day and year above written

And now, to wit, 19th day of Feb:1908 Having considered the testimony offered in this case and filed the same record, I do adjudge the foregoing to be duly proved as the last will and testament of the said Alpheus C. Montanye now deceased, and as such I do enter the same of record according to law.

In accordance with the foregoing will and probate thereof letters testamentary thereon were on the 19th day of Feb, 1908 grant unto Helen Montanye the within named executor she having first been duly sworn to well and truly administer the goods, chattles, rights, and credits which were of the said deceased according to law. Given under my hand and the seal of the Register's Office this 19th day of Feb. 1908.
