ESTATE OF SAMUEL PRINGLE, DECEASEDNo. 1334 of 1928
CERTIFIED COPY OF WILL AND CODICILS.

I, SAMUEL PRINGLE, of the Borough of Sayre, County of Bradford and State of Pennsylvania do make and declare this to be my last will and testament, in manner following, to wit:-

FIRST:- I direct that all my just debts and funeral expenses be paid by my executors, herinafter named as soon after my decease as convenient.

SECOND: I direct, devise and bequeath to my nephew Samuel Culver, for and during the term of his natural life, all my right, title and interest to and in that house and lot situate on College Street in the Borough of Kingston, County of Luzerne and State of Pennsylvania, which is known as the homestead and in which I formerly resided, and also all my right, title and interest in that house and lot situate on the Northerly side of Pringle Street, in the said Borough of Kingston, and known as the Harder property. And upon the death of said Samuel Culver, I give, devise and bequeath the remainders, the interest in said properties, to the children of my said nephew, to wit: Fannie, Jennie and Thomas Culver, to have and to hold the same, to themselves, their heirs, and assigns forever, share and share alike.

THIRD. I give and bequeath to my beloved sister, Sallie Culver, the sum of Five Hundred ($500.) Dollars.

FOURTH. I give and devise to my nephews, Thomas P. Culver and Samuel Culver, both of said Borough of Kingston, and to my nieces, Rosanna Seward, of Shickshinny, Luzerne County, Pennsylvania, and Elizabeth Good, wife of P. W. Good, of said Borough of Kingston, to the said Thomas Culver, Rosanna Seward and Elizabeth Good, and their heirs and assigns forever, but to the said Samuel Culver, for and during his natural life only, all my right, title, and interest in about twenty acres of land situate in the Township of Kingston, County of Luzerne and State of Pennsylvania, and lying Northwesterly of the Lackawanna and Bloomsburg Railroad, and a creek near said railroad (about four and one-half acres of said land being under lease to the Kingston Lumber Company); and also another tract of about twenty acres of land, in the said Township of Kingston, Lying on Pringle Hill and between said hill and the road leading from Luzerne Borough to Larksville; and also my five-sixteenths interest in three farms, one at Town Hill in said County of Luzerne, one in New Columbus Borough, in said County of Luzerne, and one in Huntington Township, Columbia County, Pennsylvania, all three said farms having been the property of my brother George L. Pringle, now deceased. And upon the death of said Samuel Carver, I give, devise and bequeath the remainders in all of said properties mentioned in this clause, and herin given to said Samuel Culver for life only, to the children of my said nephew, to wit: the said Fanny, Jennie and Thomas Culver, to have and to hold the same to themselves, their heirs and assigns forever, share and share alike.

FIFTH. I give and devise to my niece, Elizabeth Good, and to her heirs and assigns forever, that house and lot situate on the Westely side of Walnut Street, in the said Broough of Kingston, County of Luzerne, and known as the De Silva property.

SIXTH. I give and devise to my nephew, Thomas P. Culver, and to his heirs and assigns forever, that lot in the Borough of Kingston, Luzerne County; on which the said Thomas P. Culver erected a dwelling, in which he now resides.

SEVENTH. My other five lots of land in the said Borough of Kingston, and the seven acres of land situate in said Kingston Township, on the Northerly side of the road running from Luzerne to Larksville, (the said five lots being a portion of my share of the allotment made by Calvin Dimond, myself and others,) I give and devise to my said two nephews, Thomas P. Culver, Rosanna Seward and Elizabeth Good, and to their heirs and assigns forever, but to the said Samuel Culver, for and during his natural life only, and upon his death, I give, devise and bequeath the remainders in said properties mentioned in this clause, and herein given to said Samuel Culver for life only, to the children of my said nephew to wit: the said Fanny, Jennie and Thomas Culver, to have and to hold the same to themselves, their heirs and assigns forever share and share alike.

EIGHTH. I give, devise and bequeath to my siad two nephews, Thomas P. Culver and Samuel Culver, and to my two said neices, Rosanna Seward and Elizabeth Good, all my right, title and interest in a certain coal lease; now held by the Delaware, Lackawanna and Western Railroad Company, and of which Abram Nesbitt is now Trustee to receive and disburse the royalties.

NINTH. I give and bequeath to Dr. E. R. Kline, a bond for Five Hundred Dollars in the Spring Brook Water Supply Company.

TENTH. I give and bequeath to May H. Kline, the sum of Six Thousand ($6000.) Dollars. (Note. Whereas, I have given to said May H. Kline, a check for the sum of Six Thousand Dollars, on the Second National Bank of Wilkes-Barre, Pa., and the payment of which is at the present time, enjoined by the Court of Common Pleas of Luzerne County, and which has not yet been paid, now I direct that in case said injunction should be dissolved, (an application therefore being now pending,) and she receive the proceeds of said check, then the bequest shall be null and void, but otherwise to remain in force.)

ELEVENTH. I give and bequeath to Loren Effenger Kline, son of Dr. E. R. and May H. Kline, the sum of One Thousand ($1000.) Dollars.

TWELFTH. All the rest and residue of my property, real, personal and mixed, and wheresoever situate, I give and devise and bequeath, to my said two nephews, Thomas P. Culver and Samuel Culver, and my two nieces, Rosanna Seward and Elizabeth Good, their heirs and assigns, forever, share and share alike.

THIRTEENTH. I have expressly and intentionally excluded from this will, my nephew, Nelson G. Pringle, who I had made a devise and legatee, under my will dated March 31st, 1899, for adn account of his uncalled for and unjustifiable conduct in attempting to have a guardian appointed to take charge of my property, and making me unnecessary trouble and expense on account of the same.

FOURTEENTH. I expressly direct and order, that in case any one of my devisees or legatees named in this will, attempts to break or set aside the same, then, such person or persons shall forfeit his, her of their share in my estate, and said share or shares shall revert to and be distributed to my other devises and legatees in equal share.

LASTLY. I hereby nominate and appoint my friend George K. Powell, of the City of Wilkes-Barre, Luzerne County, Pennsylvania, and Rodney A. Mercur of the Borough of Towanda, Bradford County, Pennsylvania, the executors of this my last will and testament.

IN WITNESS WHEREOF, I, the said Samuel Pringle, have to this my last will and testament, typewritten upon four half sheets of paper connected together, set my hand and seal, this thirteenth day of May, A. D. One Thousand, Nine Hundred and One.

WHEREAS, I, Samuel Pringle of the Borough of Sayre, County of Bradford, and State of Pennsylvania, did, on the thirteenth day of May, A. D. One thousand nine hundred and one, make my last will and testament of that date, do hereby declare this to be a codicil to the same.

FIRST. I do hereby revoke the SECOND ITEM of said will wherein I devised and bequeathed to my nephew Samuel Culver for life, with remainder to his said children, all my interests in certain real estate situate on College and Pringle Streets in the Borough of Kingston, County of Luzerne, and State of Pennsylvania, and I now devise and bequeath all of my said interest in both properties to my nieces Rosanna Seward of Shickshinny, Luzerne County, Pennslyvania, and Elizabeth Good of said Borough of Kingston, their heirs and assigns forever, share and share alike.

SECOND. I do hereby revoke the THIRD ITEM of said will wherein I gave and bequeathed to my sister Sallie Culver, the sum of five hunderd (500.) dollars, she having died previous to the execution of said will and said item having been inserted through mistake.

THIRD. I do hereby revoke the FOURTH ITEM OF said will whereint I devised and bequeathed to my nephews Thomas P. Culver and Samuel Culver, and my nieces, Rosanna Seward and Elizabeth Good, in the manner therein mentioned, certain real estate, or my interests therein, situate in the Township of Kingston, Luzerne County, Town Hill and New Columbus Borough, Luzerne County, and Columbia County, Pennsylvania, and I now devise and bequeath the same as follows:- to my said nephew Thomas P. Culver his heirs and assigns forever, (1) all my right, title and interest in about fifteen and one-half acres of land, situate in the Township of Kingston, County of Luzerne and State of Pennsylvania, and lying Northwesterly of the Lackawanna and Bloomsburg Railroad, and a creek near said railroad, excluding therefrom any portion of the four and one-half acres leased to the Kingston Lumber Company; also all my right, title and interest in another tract of land about twenty acres, also situate in said Township of Kingston, lying on Pringle Hill and between said hill and the road leading from Luzerne Borough to Larksville; also my right, title and interest in the three farms, one at Town Hill, in said County of Luzerne, one in New Columbus Borough, in said County of Luzerne, and one in Benton Township, Columbia County, Pennsylvania, said three farms having been the property of my brother George L. Pringle, now deceased; and (2) to my said nephew Thomas P. Culver, and my friend, Dr. Effenger R. Kline of Sayre, their heirs and assigns forever, share and share alike, all my right, title and interest in the four and one-half acres, or thereabouts, situate in the said Township of Kingston, leased to the Kingston Lumber Company.

FOURTH. I do hereby revoke the FIFTH ITEM of said will wherein I gave and devised to my niece Elizabeth Good, the house and lot situate on the Westerly side of Walnut Street, in the said Borough of Kingston, and I now give and devise the same of Loren Effenger Kline son of Dr. E. R. and May H. Kline.

FIFTH. I do hereby revoke the SEVENTH ITEM of said will wherein I gave and devised to my said nephews, Thomas P. Culver and Samuel Culver and my nieces Rosanna Seward and Elizabeth Good, as was therein provided, of five lots in the said Borough of Kingston, and seven acres of land situate, in said Kingston Township, on the Northerly side of the road running from Luzerne to Larksville and I now give and devise to my said nieces Rosanna Seward and Elizabeth Good, their heirs and assigns forever, each, two lots, to be selected by them, of the allotment made by Calvin Dimond, myself and others; and to my said nephew Thomas P. Culver, his heirs and assigns forever, the said seven acres situate in the said Township of Kingston.

SIXTH. I do hereby revoke the EIGHTH ITEM of said will wherein I gave devised and bequeathed to my nephews Thomas P. Culver and Samuel Culver, and my neices Rosanna Seward and Elizabeth Good, my interest in a certain coal lease, mentioned therein, and I now give, devise and bequeath to my said nephew Thomas P. Culver, and my firend, Dr. Effenger R. Kline, in equal proportions all my right, title and interest in a certain coal lease, now held by the Delaware, Lackawanna and Western Railway Company, and of which Abram Nesbit is Trustee to receive and distribute the royalties.

SEVENTH. I do hereby revoke the NINTH ITEM of said will wherein I gave and bequeathed to Dr. E. R. Kline a bond of the Spring Brook Water Supply Company. I have given to said Dr. E. R. Kline, the bequests and devise mentioned inthe Third and Sixth Items of this codicial, in return for his kind and considerate treatment to me, since I have lived in his house, and medical treatment without making charge therefor.

EIGHTH. I do hereby revoke the TENTH ITEM of said will wherein I gave and bequeathed to May H. Kline,the sum of Six Thousand ($6000.) Dollars the same having been paid to her in my lifetime.

NINTH. I do revoke the ELEVENTH ITEM of said will wherein I gave and bequeathed to Loren Effenfer Kline, the sum of One Thousand ($1000.) Dollars, the bequest in the Fourth Item of this codicil being given to him instead.

TENTH. I give and bequeath to May H.Kline, all my wearing apparel, my new watch, bureau, iron bed stead and bedding, lounge, upholstered rocking chair and pictures.

ELEVENTH. I do hereby revoke the TWELFTH ITEM of said will wherein I gave, devised and bequeathed all the rest and any residue of my property, real, personal and mixed, and wheresoever situate, to my nephews Thomas P. Culver and Samuel Culver and to my nieces Rosanna Seward and Elizabeth Good, and I now give, devise and bequeath the same to my nephew Thomas P. Culver, his heirs and assigns forever. But I direct that all my indebtedness, which my executor shall be required to pay, and the expenses of the administration of my estate, and the payment of the collateral inheritance tax, shall be paid out of the residuum estate, and in case there shall be any deficiency remaining, then I direct that the same shall be paid by the devisees mentioned in the First, Third, and Fifth Items of this codicil, in such proportions as the values of the respective bequests shall be agreed upon by the devisees, or in case they shall fail to so agree, then I direct that my executor hereinafter named, shall fix and determine the same, according to the best of his judgement and knowledge.

TWELFTH. I do hereby revoke the appointmetn in my said will of George K. Powell and Rodney A. Mercur, to be executors of said will and testament, and I do nominate and appoint said Rodney A. Mercur, to be the sole Executor of said will and testament and of this codicil

WHEREAS, I, Samuel Pringle of the Borough of Sayre, County of Bradford, and State of Pennsylvania, did, on the thirteenth day of May, A. D. one thousand nine hundred and one, make my last will and testament of that date, and whereas, I did, on the twenty third day of January, A. D. one thousand nine hundred and two , make a codicil thereto, do hereby declare this to be a second codicil to said will.

FIRST. I do hereby revoke that portion of the FIRST ITEM in said codicil to said will wherein I devised and bequeathed all my interest in certain real estate situate on College and Pringle Streets in the Borough of Kingston, County of Luzerne and State of Pennsylvania; to my nieces Rosanna Seward and Elizabeth Good, and I now devise and bequeath all of my said interests in said properties to May H. Kline, her heirs and assigns forever.

SECOND. I do hereby revoke that portion of the THIRD ITEM in said codicil to said will wherein I devised and bequeathed to my nephew Thomas P. Culver, the following property, to wit:- (1) all my right, title and interest in about fifteen and one-half acres of land situate in the Township of Kingston, County of Luzerne, State of Pennsylvania, and lying Northwesterly of the Lackawanna & Bloomsburg Railroad, and a creek near said railroad, excluding therefrom any portion of the four and one-half acres leased tothe Kingston Lumber Company; also all my right, title and interest in another tract of land about twenty acres, also situate in said Township of Kingston, lying on Pringle Hill and between said hill and the road leading from Luzerne Borough to larksville; also my right, title and interest in the three farms, one at Town Hill, in said County of Luzerne, one in New Columbus Borough, in the County of Luzerne, and one in Benton Township, Columbia County, Pennsylvanai, said three farms having been the property of my brother, George L. Pringle, now deceased, and I now devise and bequeath the said interest to May H. Kline, her heirs and assigns forever; and (2) I do hereby revoke that portion of the THIRD ITEM IN SAID CODICIL to said will wherein I devised and bequeathed to my said nephew Thomas P. Culver and Dr. Efferner R. Kline, all my right, title and interest in the four and one-half acres, or thereabouts, situate in the said Towsnhip of Kingston, leased to the Kingston Lumber Company, and I now devise and bequeath the said interest therein, to the said Dr. Effenger R. Kline for his sole use and benefit, his heirs and assigns forever.

THIRD. I do hereby revoke that portion of the FIFTH ITEM in said codicil to said will wherein I devised and bequeathed to my niece Rosanna Seward and Elizabeth Good, each two lots of the allotment made by Calvin Dimond and others, and to my nephew Thomas P. Culver, seven acres of land situate in said Kingston Township, on the Northerly side of the road running from Luzerne to Larksville, and I now devise and bequeath said four lots, and said seven acres of land to May H. Kline, her heirs and assigns forever.

FOURTH. I do hereby revoke that portion of the SIXTH ITEM in said codicil to said will wherein I devised and bequeathed to my nephew Thomas P. Culver and Dr. Effenger R. Kline, in equal proportions, all my right, title and interest in a certain coal lease, now held by the Delaware, Lackawanna & Western Railroad company, and of which Abram nesbit is Trustee, to receive and disburse the royalties, and I now devise and bequeath the same to the said Dr. Effenger R. Kline, for his sole use and benefit.

FIFTH. I do hereby revoke that portion of the ELEVENTH ITEM in said codicil to said will whereint I devised and bequeathed to my nephew, Thomas P. Culver, all the rest and residue of my property, real, personal and mixed and wheresoever situate, and I now give, devise and bequeath the same to May B. Kline, her heirs ans assigns forever.

IN WITNESS WHEREOF, I the said Samuel Pringle, have to this second codicil to my said will and testametn, set my hand and seal, this twenty third day of January, A. D. one thousand nine hundred and three.

Decree of Probate

Whereas, on the 3rd day of March, A. D. 1904, a paper alleging to be the last will and testament of Samuel Pringle of the Borough of Sayre, County of Bradford, State of Pennsylvanai, dates the 30th day of May 1901, signed in the name of Samuel Pringle and witnessed by Wm. E. Johnson and J. T. Holcomb, and two codicils attached thereto over the name of the said Samuel Pringle dated and witnessed respectively Jan. 23, 1902, witnessed by Wm. E. Johnson and J. T. Holcomb, and Jan. 23, 1903. witnessed by Wm. E. Johnson and J. T. Holcomb, was presented for probate before the undersigned, Register of Wills for the County of Bradford, State of Pennsylvania, upon the due proof of the death of the said Samuel Pringle, having been made; to which certain heirs, to wit:- N.G. Pringle et al., filed a cavat against the probate of the said will and codicils to the same, and upon which issue numerous hearing have been had and voluminous testimony taken, all of which is filed of record herewith.

Now therefore, I, the undersigned Register of Wills in and for the said County of Bradford, and State fo Pennsylvania, after a careful consideration of the facts and testimony taken, do hereby find teh said Samuel Pringle to be of sound mind, memory and understandings at the respective dates of making said wills, and codicils thereto attached, and adjudge the same to be duly proved and the same is admitted as the last will and testament of the said Samuel Pringle, late of the Borough of Sayre, deceased, and as such I do enter the same of record, according to law, and dismiss the cavat filed thereto, this the 26th day of November, A. D. 1904.

FANNING, Register of Wills and Recorder of Deeds, and Clerk of the Orphans' Court for the County of Bradford, in the said State, do hereby certify that I have compared the foregoing copy of the last Will and Testament of Samuel Pringle, late of the Boro of Sarye, County of Bradford and State of Pennsylvania, deceased, together with proof of will and decree of probate, as made on the 26th day of November, A. D. 1904, Register's files No. 7634 with the original thereof now on file and remaining of record in this office, and do find the same to be a true copy of, and correct transcript from, such original record and of the whole thereof.
